01Agreeing to these terms
By using mtvernon.co, creator.mtvernon.co or any Mount Vernon tool ("the services"), you agree to these terms and our Privacy Policy. If you don't agree, please don't use the services.
You need to be at least 13 to use the services. If you're under 18, a parent or guardian has to agree to these terms with you.
02Artist Portal accounts
- Portal accounts are by invitation, for Mount Vernon artists, team members and Network members.
- Keep your login to yourself and tell us right away at [email protected] if you think someone else has used it. You're responsible for what happens under your account.
- Give us accurate details, especially your PayPal account for payouts.
- We can suspend or close an account that breaks these terms, puts others at risk, or when an artist's agreement with Mount Vernon ends. You can close yours any time by emailing us.
03Connecting your other accounts
When you connect Spotify, Apple Music, SoundCloud, YouTube, Instagram, Facebook or TikTok, you let us read the information described in the Privacy Policy to show you your numbers. You must own or be authorized to manage each account you connect, and you still have to follow that platform's own terms (for YouTube, the YouTube Terms of Service). You can disconnect at any time.
Numbers, scores, "heat", ad suggestions and release-radar tips are estimates built from what the platforms report. They can be late, incomplete or wrong, and they're guidance, not a promise of results.
04Creator Suite tools
- Templates (EPK, merch mockups, danger-zone overlays and the rest of Assets) are for promoting your own music. Use and edit them freely for that; don't resell them as templates.
- Legal Templates are drafts, not legal advice. Using them doesn't make Mount Vernon your lawyer. Bring filled-in drafts to the Mount Vernon legal team before anything is signed.
- Playlist Guard points you to independent third-party sites (SubmitHub, Groover, Spotify for Artists and others). We don't control them, aren't paid by them, and can't promise any placement or result. Its playlist checker gives an opinion from public signs, not a guarantee.
- Vevo Support links to your distributor's own pages. Their prices, rules and approvals are theirs.
- Presave, Smart Reply and Email Aid+: only contact fans who chose to hear from you, honor every unsubscribe, and follow anti-spam laws and each platform's messaging rules.
05What you can't do
- Buy or create fake streams, followers, plays or engagement, or use our tools to do it. It breaks every platform's rules and can get your music taken down.
- Upload or sell music, art or video you don't have the rights to.
- Harass, spam or mislead people, or impersonate anyone.
- Break into, overload, scrape or reverse-engineer the services, or get around their security.
- Use the services for anything illegal.
06Buying music and merch
- Prices are shown at checkout. Payments go through PayPal (or the checkout shown at purchase), under their terms.
- A music purchase gives you a personal, non-transferable right to download, keep and listen to it. It doesn't let you re-upload, share, resell or use it commercially.
- Because downloads are delivered instantly, music sales are final. If a file is broken or never arrives, email [email protected] within 30 days and we'll fix it or refund you.
- Merch pre-orders ship when the item is ready; the product page says the timing. Contact us about damaged or wrong items within 30 days of delivery.
07Artist sales and payouts
Artists' share of store sales is set by their agreement with Mount Vernon. Payouts are sent monthly to the PayPal account connected in the portal once there's a balance to pay. You're responsible for your own taxes and for keeping your PayPal account in good standing; we may hold a payout while we check a problem (for example a refund, chargeback or an account mismatch).
08Your content and ours
Your music stays yours. Anything you upload or share through the services (releases, cover art, bios, photos, pitches) remains owned by you or your licensors. You give Mount Vernon permission to host, display and distribute it as needed to run the services you're using, such as selling a release in the store or showing it on the site. This ends when you remove it, except for copies people already bought.
The Mount Vernon name, logos, site design and our own tools and templates belong to Mount Vernon. Your separate agreement with Mount Vernon, if you have one, wins over these terms where they differ.
09Other companies' services
The services connect to and link to other companies (PayPal, Spotify, Google/YouTube, Meta, TikTok, SoundCloud, Apple, distributors and playlist sites). Their services are governed by their own terms and privacy policies, and we aren't responsible for them.
10No guarantees
We work hard to keep everything running and accurate, but the services are provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise they'll always be available, error-free or lead to any particular result for your music.
11Limits on our liability
To the fullest extent the law allows, Mount Vernon won't be liable for indirect, incidental, special or consequential damages, or for lost profits, data or opportunities. Our total liability for any claim about the services is limited to the greater of what you paid us in the 12 months before the claim or $100. Some places don't allow these limits, so they may not all apply to you.
12Disputes
These terms are governed by the laws of the State of Ohio and the United States, and any dispute will be handled in the state or federal courts located there. Before going to court, contact us at [email protected] and we'll try to sort it out in good faith first.
13Changes
We may update these terms as the services change. We'll change the date at the top, and for important changes we'll let artists know in the portal or by email. Using the services after that means you accept the new terms.
